Terms of Service

These Terms of Service ("Terms") govern your use of the AgentTekHub platform operated by Agent Tek Hub LLC ("Company," "we," "us," or "our"). By creating an account or using our services, you agree to these Terms.

1. Service Description

AgentTekHub is a software-as-a-service (SaaS) platform that provides real estate agents and brokerages with website hosting, IDX property search, CRM, email marketing, SMS messaging, virtual tours, webinars, AI content generation, appointment booking, and related tools.

2. Account Registration

To use AgentTekHub, you must create an account and provide accurate, complete information. You are responsible for maintaining the security of your account credentials and for all activity under your account. You must be at least 18 years old and a licensed real estate professional (or authorized representative of a brokerage) to use the service.

3. Subscription and Billing

• Pricing: The base subscription is $98/month. Additional agents may be added for $25/month each. Add-on packs (SMS, AI images, storage) are available at posted prices.
• Billing: Subscriptions are billed monthly via Square. Payment is due at the start of each billing cycle.
• No Contracts: All subscriptions are month-to-month with no long-term commitment.
• Cancellation: You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period.
• Refunds: No refunds are provided for partial months. If you cancel mid-cycle, you retain access through the end of your paid period.
• Price Changes: We may change pricing with 30 days' notice via email. Continued use after the price change constitutes acceptance.

4. Acceptable Use

You agree NOT to:

• Send unsolicited bulk email (spam) or violate CAN-SPAM regulations
• Violate the Fair Housing Act or engage in discriminatory practices in your listings, content, or communications
• Use the platform for any illegal purpose
• Attempt to gain unauthorized access to other accounts or our systems
• Upload malicious code, viruses, or harmful content
• Resell or redistribute the service without written permission
• Use the platform in a way that degrades performance for other users

5. MLS Data

MLS listing data is provided through MLS Grid and is subject to your MLS's rules and regulations. You agree to:

• Use MLS data only for display on your AgentTekHub website as permitted by your MLS
• Not scrape, download, redistribute, or repurpose MLS data
• Maintain a valid MLS membership and IDX agreement
• Display all required MLS disclaimers and attribution

We are not responsible for the accuracy or completeness of MLS data. If your MLS membership lapses, your IDX listings will be deactivated.

6. Your Data

• Ownership: You own all data you upload or create on AgentTekHub, including contacts, content, images, and marketing materials.
• Export: You may export your contacts and data at any time via CSV export.
• Responsibility: You are responsible for having appropriate consent and privacy policies for any personal data you collect through your AgentTekHub website (leads, contacts, etc.).
• Backup: While we take reasonable measures to protect your data, you are encouraged to maintain your own backups via regular exports.

7. AI-Generated Content

AgentTekHub provides AI content generation tools powered by third-party AI services. AI-generated content is provided as a starting point and should be reviewed before publishing. You are responsible for the accuracy and compliance of all content published on your site, whether AI-generated or manually written.

8. SMS Messaging

SMS messaging is provided through Twilio. By enabling SMS on your AgentTekHub account, you agree to the following:

• Consent required: You must obtain explicit, documented TCPA-compliant consent from each recipient before sending any text message. Consent must be clearly disclosed at the point of collection (e.g., a checkbox on your contact form stating "I agree to receive text messages from [Your Brokerage Name]. Message and data rates may apply. Reply STOP to unsubscribe.").
• Consent records: You must maintain records of consent (timestamp, IP address, form used) for each recipient. These records may be requested by Agent Tek Hub LLC or carriers during compliance audits.
• Opt-out handling: The platform automatically processes STOP requests and removes opted-out contacts from SMS communication. You must not manually re-add or circumvent opt-outs.
• Prohibited content: You must not send messages containing illegal content, deceptive claims, or content that violates the Fair Housing Act, TCPA, or any other applicable law.
• Message types: SMS may only be used for legitimate real estate business communications including appointment reminders, listing alerts, showing confirmations, and follow-up messages that recipients have consented to receive.
• Frequency: You must not send excessive messages. Recommended frequency is no more than 10 messages per contact per month unless the contact has explicitly opted into higher-frequency alerts.
• Enforcement: Violation of SMS regulations may result in immediate suspension of your SMS capabilities and/or account termination. Agent Tek Hub LLC reserves the right to suspend SMS access at any time if we reasonably believe a violation has occurred.

Agent Tek Hub LLC provides the SMS infrastructure but is not responsible for message content, recipient lists, or consent compliance. You agree to indemnify Agent Tek Hub LLC against any claims arising from your SMS usage.

9. Social Media Integration

AgentTekHub allows you to connect your Facebook Page and Instagram Business account for social media posting. By connecting your accounts, you agree to the following:

• Authorization: You authorize AgentTekHub to publish posts, including text and images, on your connected Facebook Page and/or Instagram Business account on your behalf.
• Content responsibility: You are solely responsible for the content of all social media posts published through AgentTekHub, whether manually created, AI-generated, or scheduled. You must review all content before publishing or scheduling.
• Compliance: You agree to comply with Meta's Terms of Service, Community Standards, and advertising policies when posting through AgentTekHub.
• Fair Housing: All social media posts related to real estate must comply with the Fair Housing Act. You must not publish content that discriminates based on race, color, religion, sex, national origin, familial status, or disability.
• Token access: AgentTekHub stores an encrypted access token to post on your behalf. You may revoke this access at any time by disconnecting your account in Settings.
• Service availability: Social media publishing depends on third-party APIs (Meta). AgentTekHub is not responsible for posting failures caused by Meta API changes, outages, or policy enforcement.
• No guarantees: AgentTekHub does not guarantee post reach, engagement, or compliance with Meta's evolving content policies. You are responsible for monitoring your own social media accounts.

10. Custom Domains

Domains registered through AgentTekHub via our domain registration service are registered in your name. If you cancel your subscription, the domain remains yours — you may transfer it to another registrar. You are responsible for domain renewal costs after your subscription ends.

11. Service Availability

We strive to maintain high uptime but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience outages. We are not liable for any losses resulting from service downtime.

12. Limitation of Liability

To the maximum extent permitted by law, Agent Tek Hub LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising from your use of the service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Agent Tek Hub LLC from any claims, damages, losses, or expenses arising from your use of the platform, your content, your violation of these Terms, or your violation of any third-party rights.

14. Termination

• By You: Cancel anytime from your account settings.
• By Us: We may suspend or terminate your account for violation of these Terms, non-payment, or any activity that harms the platform or other users. We will provide notice when reasonably possible.
• Effect: Upon termination, your website will be taken offline. You may request a data export within 30 days of termination.

15. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via email at least 30 days in advance. Continued use of the service after changes take effect constitutes acceptance.

16. Governing Law

These Terms are governed by the laws of the State of North Carolina, United States. Any disputes shall be resolved in the courts of North Carolina.
